Why Should an Accident Victim Tell His Attorney Everything?

This may seem obvious to you, but as an attorney not being aware of a critical fact and being broadsided by it by the defense attorney at trial is not fun. It is not fun for your attorney and in the long run will diminish the strength of your case. You can be relatively certain that the insurance company is going to find out whatever it is you are trying to hide.

I have an attorney friend who had prepared his client for his deposition. He felt the client was ready and well prepared. There was no doubt that he would testify well and make a good witness. Once the client was sworn in and began testifying my friends jaw figuratively hit the conference room table. The client was not testifying the same as he had during the preparation for deposition. He was not saying the same things he had said during preparation. The facts as well as the story were different. When the deposition was over my friend asked his client why he had testified so differently at his deposition than he had during the prior preparation. The client answered "You didn't have me under oath in your office". The case was lost at this point.

I know this seems like something I made up. It does sound a little farfetched, but unfortunately it happened. Situations very similar to this occur frequently. People for some reason don't trust attorneys, even their own. Your attorney is on your side and will fight for you if you give him the facts to use as ammunition.

You must tell your attorney everything so that he can prepare the best strategy and game plan for your case. He is on your side. He is your hired gun. I received a call from the insurance adjuster on my client; I will call him Jack, a few weeks ago. He was asking me how Jack's treatment was going. A very normal call, until the bomb was dropped. Jack's case has been severely damaged and there is little chance for recovery. It does not matter how badly he is hurt and how much pain he is in. Jack will be portrayed as a liar by the insurance company and there is little chance for a fair and reasonable recovery.

Your attorney needs to know everything if he is going to properly represent you. Information that you feel is not important may be, it is part of your attorney's job to determine what is important and what isn't. Your attorney is there to represent you and not judge you. Tell him everything.

(6) Call Your Car Insurance Provider. Your policy might have additional benefits such as car rental, lost wages, towing, etc. that you might not be aware of. Make sure you check the terms of these benefits such as car rental, there may be a time limit, or a cost limit. It's good to know that going in.

(7) Call Your Credit Card Company. If you're going to miss work, or wait to be compensated to try and cover your credit cards, it's a good idea to call them and let them know. You might have been paying a couple bucks a month for some sort of "payment protection" with them that would put on hold, or make your minimum monthly payments for you while you're off from work.

(8) Call the Bank or Leasing Company. If you are leasing your car it might be a good idea to call the Leasing Company and let them know. They might also be able to help with a loaner car. They'll appreciate you keeping them in the loop. If you own your car, but have a bank loan, it's probably a good idea to call them, let them know, and also find out exactly what you owe on the car, and ask them to check what the Blue Book value is on your vehicle in case it makes more sense to "total" the car.

I Had a Car Accident - Do I Need an Attorney?

Every day in California, with its network of Freeways and traffic congestion, there are thousands of car accidents ranging from minor fender benders to catastrophic life altering experiences and/or death. If you are one of the unfortunate people who are in this group you undoubtedly have asked yourself the question "Do I need an Attorney?"

In cases where the injuries are substantial there is no question that a qualified and experienced personal injury litigator should be retained as quickly as possible. They never "come out of nowhere". That statement, given to an insurance company, even if you knew exactly where that car came from, will cause damage to your case. That is just one of the many little things that an experienced attorney will make sure is avoided thereby protecting the value and integrity of your case.

It is very typical that the extent of ones injuries are not fully appreciated until a few months after the accident occurred. It is the usual pattern that a person is first diagnosed with "soft tissue injuries" if x-rays do not reveal any broken bones. The custom and practice is for these patients to receive medication and some sort of physical therapy to aid with the healing process, however some of these accident victims do not recover as is predicted. Many develop all different types of symptoms including radiating pain down the limbs known as "radiculapathy". This is a significant finding that requires immediate medical attention and more diagnostic testing including, but not limited to, an MRI of the affected area. In a worst case scenario the MRI will reveal a positive finding that there is some "disc pathology" which might require anything from medication, pain management, and epidural injections to complex spine surgery. Unless you have an Attorney to properly manage your case and navigate the hurdles for you, the wrongdoer's Insurance Company, and their Attorney, will do everything they can to minimize your claim and present what is nothing less than a frivolous defense to your righteous case.

The defense attorney will obtain every single medical record that exists relating to treatment you have received going back as far as they can which often times is decades. They will look for any little notation in any medical chart they can find to try and link your present complaints to some other unrelated event. This is what they do!
